The big question is when will the Senate reauthorize IDEA S1248? Three months ago, the Senate Health, Education, Labor, and Pensions (HELP) Committee approved the bill, and the plan was for the HELP Committee’s report to be completed in early October. Then, S1248 would be sent to the full Senate.

Now, there are two differing opinions. One still expects the bill to go to the Senate floor next week when the Senate returns from recess, and the other does not see the bill being considered until late winter or early spring. DLD leadership has already sent letters highlighting areas we support and our areas of concern to the entire HELP Committee as well as other key players, because we could not be sure of the schedule.

The schedule is uncertain because only 3 of 11 appropriations bills have been signed into law. All have to be passed by the time Congress adjourns for the year.

It is known that Senator Kennedy (MA) and Senator Gregg (NH) must agree to the following conditions:

  • No more than three amendments will be offered by each party,
  • Both sides must agree on the schedule and length of debate and
  • No secondary amendments will be allowed.

What do we do? Contact your two Senators and request the Senate Reauthorization bill be brought to the floor for a full vote before the end of the year.
